1. Introduction
1.1 These Terms and Conditions apply to your purchase of any Products from us on our Website or through our team.
1.2 All purchases made on this website are governed by these Terms and Conditions. The Terms and Conditions governing any purchase will be those in effect at the date of your order. If you order Products after we have published any changes, you will be bound by those changes. Please check our Terms and Conditions before each order.
1.3 We may amend these Terms and Conditions at any time to remain compliant with relevant laws and regulations, or to reflect changes to our business operations.
1.4 We have tried to make these Terms and Conditions easy to understand. If any section is unclear, our team is here to help.
1.5 If you have a query about these Terms and Conditions, or you do not accept them, please contact us at info@geeknson.com.
2. Definitions
"Product" or "Products" means the products which are available for purchase, and described, on our Website.
"Terms and Conditions" means these terms and conditions of sale, which you can access on our Website.
"Website" means geeknson.com.
"Working Day" means any weekday excluding public holidays.
"You" and "Your" means you as our customer.
3. Placing an order
3.1 This section sets out how a legally binding contract is formed between you and us.
3.2 You may purchase Products from us by placing an order on our Website, or by contacting our sales team by email at info@geeknson.com.
3.3 You are responsible for ensuring that the information you provide to us is correct, including your email address and delivery address, otherwise we may not be able to confirm your order and deliver the Products to you.
3.4 We will send you an email as soon as possible to the address you have provided, confirming receipt of your order, your payment, your order number and your personal details (the "Order Acknowledgement").
3.5 No order has been accepted by us until we have received payment from you or from a third party finance provider, and have sent you an Order Acknowledgement. A contract is formed when we accept your order in accordance with this paragraph.
4. Product specifications
4.1 We and our suppliers have a policy of continuous product development and reserve the right to amend the specifications of any Products without prior notice in relation to future sales. Products supplied may therefore differ slightly from those on display or advertised online.
4.2 All our furniture is made from natural wood, and appearance may vary. Some woods will mellow with age and exposure to sunlight. Knots, grain variation and filling are natural characteristics of solid wood and are part of the manufacturing process. This does not affect your statutory rights.
4.3 We advise that our solid hardwood furniture is treated with wax. Please treat the whole Product, not only the top. This does not affect your statutory rights. If you believe the condition of your Products is unacceptable, please contact our team.
4.4 On rare occasions, due to changes in climate, you may notice slight swelling, expansion or contraction of the wood. Where possible, keep the leaves on the table when the table is not in use.
4.5 Some Geeknson tables include design features that help reduce the risk from small spills, but a table is not a sealed liquid-proof container. Protection depends on the model and configuration. We recommend using a transparent tablecloth or another protective cover when the table is used for food and drinks.
5. Prices, VAT and sales tax
5.1 The price of the Products is as notified to you by our sales team, or as indicated on the order pages when you submit your order on the Website.
5.2 In the United Kingdom, listed prices include VAT where applicable, at the prevailing rate, and are subject to any promotional offer or discount.
5.3 In the European Union, listed prices include VAT where applicable.
5.4 In the United States, sales tax is added at checkout.
5.5 For other destinations, our team confirms the position case by case before dispatch or before the final delivery steps. Taxes, customs and delivery handling depend on the destination. Your invoice shows all charges Geeknson Ltd is required to show for transport, customs and accounting.
5.6 We take all reasonable care to ensure that the price advised to you is correct. It remains possible that some prices are incorrect. If we accept and process your order where a pricing error is obvious and unmistakable, and could reasonably have been recognised by you as a mispricing, we may end our contract with you, refund you any sums you have paid, and require the return of the Products from you.
6. Made to order and deposits
6.1 Our tables are made to order. Production times are shown on the product pages and in our Frequently Asked Questions. Most standard tables take 3 to 4 months in production. Some larger or more complex models, such as Henry, may take 4 to 5 months. Custom tables take 6 months or more. Chairs and benches take about 2 months.
6.2 Production time is not the same as your delivery date. Our team confirms the delivery method and timing with you before dispatch.
6.3 Custom orders may require a non-refundable deposit, confirmed by our team before the order is placed.
7. Delivery
7.1 Delivery terms are set out in our Shipping Policy, which forms part of these Terms and Conditions.
8. Cancellation
8.1 Cancellation and refund terms are set out in our Refund Policy, which forms part of these Terms and Conditions.
9. Your rights where we deliver faulty Products
9.1 By law, we are required to supply Products which are as described by us, fit for purpose and of satisfactory quality.
9.2 Please contact us using the details above to discuss a resolution, which may include a repair, replacement parts, a replacement Product, an allowance or a refund. We will ask you to provide certain information about the Product in question, including photographs or video, to enable us to investigate and resolve the issue.
9.3 We guarantee all Products against faulty workmanship and faulty materials for a period of 12 months from the actual date of delivery. In all cases we reserve the right to inspect the Product and verify the fault.
9.4 These guarantees do not cover fair wear and tear, or the natural characteristics of wooden Products including movement in wooden Products; neglect; abuse or misuse of your Products, including failure to follow the correct care procedures set out above; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage; or loss or damage caused by a third party.
9.5 Where you agree, we will arrange to repair a defective Product free of charge. Alternatively, at our discretion, an allowance may be made for you to arrange a local repair. If a repair is not possible or practical, we will offer you, at our discretion, a replacement or a refund. Where a replacement is no longer available, or circumstances make a replacement impractical, the Product may be replaced with a part that closely matches it. We reserve the right to instruct an independent third party furniture specialist to inspect and, where you agree, repair your furniture.
9.6 Nothing in this section affects your statutory rights.
10. General terms
10.1 In purchasing a Product, you represent and agree that you are buying the Product solely for your personal use, and not for business reasons such as resale or commercial distribution.
10.2 These Terms and Conditions are available in English only.
10.3 You may not transfer any of your rights under these Terms and Conditions to any other person.
10.4 We may transfer any of our rights under these Terms and Conditions to any person, or ask any person to fulfil any aspect of them, so long as performance of these Terms and Conditions is not affected.
10.5 Only you and we have any rights under these Terms and Conditions. No other person shall have any rights under them.
10.6 You may not use our trademarks or intellectual property without our prior written consent.
10.7 If you are a consumer, nothing in these Terms and Conditions will affect your statutory rights.
10.8 If any of these Terms and Conditions are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these Terms and Conditions shall remain in full force and effect.
10.9 These Terms and Conditions, together with your order, set out the whole of our agreement relating to the supply of Products to you by us.
10.10 These Terms and Conditions are governed by the laws of the United Kingdom.
